The Nebraska Game and Parks Commission (Commission) has been given authority to promulgate Orders, Rules and Regulations by numerous statutes contained in the Revised Statutes of Nebraska. The Unicameral, which is the legislative branch of the State of Nebraska, develops laws that are approved by the Governor (executive branch) and interpreted by the courts (judicial branch).
Because of the variety of activities that the Commission oversees, it would be difficult to have statutes attempt to address every situation, thus Orders, Rules and Regulations are established. To establish Rules and Regulations the Commission must comply with the Administrative Procedure Act. Before Rules and Regulations are adopted, the Commission must give public notice, conduct a public meeting, and then approve the new Rules and Regulations. Regulations become effective after they have been signed by the Governor.
The creation of Commission Orders was authorized by the Nebraska Legislature in 2013. Commission Orders require a public notice and public meeting process similar to Regulations, but unlike Regulations they become effective 15 days after approval by the Commission and posting on the Commission's web site. Commission Orders are generally limited to defining species-specific open seasons, bag limits, and size limits for hunting, fur-harvesting, and fishing. The Commission will begin transitioning some qualifying rules from Regulations to Commission Orders in the fall of 2013. Outdoor recreationists should review all relevant Regulations and Commission Orders before going afield.
