ANGLER REGULATION REMINDER FOR CARTER LAKE

April 4, 2012 In The Wild 3 Comments
Helping to get the word out that you can keep only one largemouth bass 21 inches or longer caught from Carter Lake in northeast Omaha. Keep in mind that substantial fines, liquidated damages, etc. will be assessed to those individuals who insist on violating this regulation!

    Mr. Wagner,

I’ve contended in the past that the “substantial fines, liquidated damages, etc.” have not been large enough to be considered a violation “deterrent”!

Maybe it has changed. Can you provide the current $$$ for these violations?

In MY opinion, the odds of “getting caught” are so slim that it would require a MAJOR fine, and/or more-so a HEAVY liquidation damage (like adding a double or triple indemnity clause to the law) to be a representable “deterrent’”!

In MY OPINION, an 18.5″ fish would then NOT be considered “close enough” and the chance taken that one would be “caught”.

      Hi Harold,

Thanks for the note. Say, in my view, those fines, liquidated damages, court costs, permit revocations, etc. are a collective viable deterrent, that’s why they are there! In addition, the caught violator gets a criminal record! You need to know that our conservation officers diligently work the various lakes/reservoirs here in the Omaha-metro area and the chances of getting contacted by an officer while fishing are pretty darn good! With regard to the exact dollar amounts for the violations, liquidated damages, etc., here are a two website links to visit:

      http://www.supremecourt.ne.gov/rules/pdf/waiverfine.pdf

      http://nebraskalegislature.gov/laws/browse-chapters.php?chapter=37

There are far too many variables that would be involved in a violation scenario for me get into the exact dollar amounts that could be levied to an individual. Keep in mind that it is my role as a public information officer at the Nebraska Game and Parks Commission to not only serve the public, but also the divisions the agency has (e.g. fisheries, law enforcment, etc.) and how they would like me to get information across to the the ‘outdoor public’ to make them think twice about violating a law/regulation so a citation doesn’t have to be issued.

To influence change on raising fines, liquidated damages, and such, I think you know, but you need to talk your state senator, your Game and Parks Commission board member, etc.

Thank you for your time and interest in this! I do sincerely apppreciate it, Harold! Have a good one! Greg Wagner/NE Game and Parks Comm. – Omaha.
